The original Penal Code had no provision for punishment in those circumstances where a person’s negligence results in the death of another. That is to say, liability for causing death was confined merely to murder and culpable homicide not amounting to murder. To fill in this loophole, section 304A was inserted in the Penal Code by the Indian Penal Code (Amendment) Act 27 of 1870 to include all those cases where a person causes the death of another by such acts that are rash or negligent but there is no intent to cause death and no knowledge that the act will result in death. The Essentials ingredients of section 304A are as given below: There must be the death of a person; The death must be caused by the act of accused; The death must be caused due to any rash or negligent act of the accused; The accused’s act must not amount to culpable homicide. The section applies when there is a direct link between the rash or negligent act of the accused to the death of the person that is in question. The act must result in the immediate cause for the death.
