Goonda Act is a special law enacted with the intention of curbing the menace of ‘Organized Crime’ or ‘Criminal Syndicate’ or ‘Underworld Gangs’. Various states in India have enacted a special legislation to deal with Organized Gangs and mafia syndicates. The genesis of Goonda Act can be traced backed to 1923 in British Era when such special law was enacted to deal with the menace of ‘Goondaism’. The Goondas Act, 1923 was enacted to control certain Goondas residing in, or frequenting Calcutta or the neighbourhood of Calcutta, and for their removal elsewhere in certain circumstances. Goonda Act mostly gives special powers to the Executive Magistrate to arrest, detain or extern a member of any gang or any person designated as a ‘Goonda’. Post independence of India, many states enacted legislation to deal with Goondas. Following states have enacted special law to deal with Goondas : Madhya Pradesh, Uttar Pradesh, Rajasthan, Tamil Nadu, Karnataka, Kerala, Punjab, Maharashtra.
